Statement From Senator Liz Krueger On Passage Of Sexual Harassment Bill

Albany – State Senator Liz Krueger released the following statement today regarding S.6577, legislation that addresses workplace harassment:

“I am humbled and honored that in our first session in the Majority we were able to deliver this critically important piece of legislation on behalf of women and men across New York State. I am hopeful that because of this legislation, as part of a much larger agenda of addressing harassment in the workplace, five years from now we will be able to look back and say ‘it’s getting better.’ We have made clear today that you can’t get away with it anymore.

“For years I have heard from young women right here in the Legislature who have been harassed and abused in their workplace. They told me they couldn’t afford to lose their job, they couldn’t afford to come forward. They were convinced that if they did, they’d never work in Albany again.

“Nobody should have to be afraid when they go to work that they are going to have to face violations not just of their bodies but of their souls. Because that’s what it is to be abused and harassed and sexually attacked in the workplace.

“The legislation we passed today is not yet enough, but it is a huge victory nonetheless. I am so proud of my colleagues, especially Senator Biaggi and the other new senators who have done an extraordinary job getting us here. I also want to recognize the members of the Sexual Harassment Working Group who so boldly came forward, demanded we do better, demanded we listen to their stories, and demanded we and pass legislation that is more than just a feel-good effort.

“It is clear now that MRTA is not going to pass this session. This is not the end of the road, it is only a delay. Unfortunately, that delay means countless more New Yorkers will have their lives up-ended by unnecessary and racially disparate enforcement measures before we inevitably legalize.

“Through months of negotiation and conversation with the Governor’s office and my legislative colleagues, we made great strides to improve our bill and bring more people on board. We came very close to crossing the finish line, but we ran out of time.

“I will continue to push for a tax-and-regulate adult-use program with all the right safeguards in place, one that centers on restorative justice and reinvestment in the communities most harmed by decades of failed prohibition policies.

“We will build on the success of other states who have chosen to legalize, including many of our neighbors. I have no doubt that prohibition is an outdated and irrational policy, and its days are numbered.”

Senate Democratic Majority Passes Historic Climate Leadership And Community Protection Act

Albany – The Senate Democratic Majority today passed the Climate Leadership and Community Protection Act (CCPA) to address and mitigate the effects of climate change by drastically cutting greenhouse gases, diverting the state’s energy reliance to renewable sources, and creating green jobs to promote environmental justice across New York State. This bill is the most comprehensive and aggressive climate change legislation in the nation.

“Today marks a historic day for New York State in the fight against climate change,” Senate Majority Leader Andrea Stewart-Cousins said. “As our leaders in Washington fail to take action, New York needs to lead in this time of great crises for our planet. I commend Senator Todd Kaminsky for championing this bill and protecting New York’s future generations.”

“This bill is the most ambitious climate legislation in North America,” said Senator Liz Krueger. “It sets a goal of net-zero emissions economy-wide by 2050, while ensuring that frontline communities and the needs of workers remain front and center. Senate Passes Bill To Remove Cap On Bus Lane Cameras In NYC

Albany – Today the State Senate passed legislation carried by Senator Liz Krueger (S.1925-B/A.6777-B) that would remove caps for automated enforcement cameras in bus lanes in the City of New York. The legislation creates a graduated schedule of fines for repeat offenders and directs revenue from fines to the Metropolitan Transportation Authority (MTA). The bill is carried in the Assembly by Assm. Nily Rozic.

“A reliable public transit system is the lifeblood of New York City and the entire region,” said Senator Krueger. “Buses are integral to that system, and are used by vast numbers of New Yorkers every day. But without camera enforcement, dedicated bus lanes are just so many painted lines. Albany should not prevent the City from deploying the necessary tools to improve bus service and reduce congestion.”

“Removing caps on automated enforcement cameras for dedicated bus lanes in New York City as part of the Select Bus Service (SBS) program will go a long way toward improving bus speeds and reducing service delays,” said Assemblywoman Rozic. “As the representative of a district that relies solely on buses for all mass transit needs, I have witnessed firsthand how SBS plays a vital role in filling the service gaps and improving connectivity in and out of Queens.”

The New York City bus system serves over two million riders daily. However, due to worsening congestion throughout the city, bus speeds have declined significantly in recent years. This has coincided with a significant and ongoing decrease in bus ridership, as riders switch to other transit modes, increasing crowding on the subways and traffic congestion on city streets.

Beginning in 2008, the New York City Department of Transportation and the MTA have collaborated on a bus rapid transit program known as Select Bus Service, or SBS. SBS routes are outfitted with a number of special features that have resulted in bus speed increases as high as 30%, and ridership increases of about 10%. One very effective element of the SBS program has been the addition of dedicated bus lanes and bus lane enforcement cameras along SBS routes.

The New York City Department of Transportation (DOT) and the MTA have both released plans for improving bus service that include expanded use of bus lanes and bus lane enforcement cameras along more bus routes in the city. However, state law currently limits the use of bus lane enforcement cameras to just 16 bus routes in the city. NYC DOT has installed additional bus lanes beyond the designated 16, but lacks the ability to enforce them with cameras, limiting their effectiveness as drivers often violate them with impunity.

S.1925-B/A.6777-B would allow the City of New York to expand the use of bus lane enforcement programs as it sees fit and free New York City police resources to be directed elsewhere. It also lowers the maximum fine for a single bus lane camera violation to $50 and institutes a graduated fine schedule up to $250 for repeat offenders as an added deterrent. Finally, this law directs the funds raised by the fines from these cameras to the general transportation account of the New York City Transportation Assistance Fund established in the 2018-19 budget to provide additional revenue to the Metropolitan Transportation Authority.

Senator Krueger and Assemblymember Paulin Cheer Passage of Bill to Protect Against a Federal Assault on the Integrity of Non-Profits and Houses of Worship

Albany – Senator Liz Krueger (D-Manhattan) and Assemblymember Amy Paulin (D-Scarsdale) applauded passage of a bill to preserve existing restrictions on houses of worship and 501(c)(3) not-for-profit organizations from participating or intervening in political campaigns in support or opposition to a candidate for office. The bill (A. 623 / S. 4347) would enshrine in state law the 65-year balance achieved under federal tax law by the “Johnson Amendment,” whereby religious and 501(c)(3) non-profit corporations are granted tax-exempt status but may not endorse or oppose a candidate for political office.

“This is a simple bill that serves an important purpose – to keep in place standards we have had in this country for over sixty years that shield not-for-profits and houses of worship from political entanglement,” said Senator Krueger. “The administration in Washington has repeatedly said they want to repeal these protections, and open the door for big-money donors to launder campaign contributions through churches, mosques, and synagogues. This bill makes clear that in New York State we know this long-held standard is not broken, and we don’t want Washington to try to ‘fix’ it.”

“Under this bill, New York would become the first state to protect against a potential flood of undisclosed campaign contributions through third parties to sway our elections that would perversely confer a tax benefit to the donors,” said Assemblymember Paulin. “The strongest voices defending the Johnson Amendment have come from thousands of nonprofit organizations, charities, churches, synagogues, and other congregations who believe it serves an essential purpose in reassuring the public that their charitable mission warrants their tax-exempt status, and that they conduct themselves with independence and integrity. If the federal government will not defend this tradition of decency and nonpartisanship, then New York must.”

This provision within federal tax law for 501(c)(3) tax-exempt entities is referred to as “the Johnson Amendment” after sponsor and then-Senator Lyndon Baines Johnson. The measure was so uncontroversial that it was included by the U.S. Senate without discussion or debate in the Internal Revenue Code of 1954 which was signed into law by President Dwight D. Eisenhower. It was reaffirmed and strengthened under President Ronald Reagan and a Democratic Congress in 1987.

However, President Donald Trump and Vice President Mike Pence repeatedly promised to repeal this requirement under tax law throughout their campaign, and have only escalated their rhetoric since taking office. President Trump in an interview with Rev. Pat Robertson for The 700 Club falsely claimed that he had already repealed the law. Throughout the past two years, there were frequent attempts at repeal via standalone bills, as well as attempts to incorporate repeal into larger pieces of legislation, including the House of Representatives version of federal tax reform.

Thus far, attempts at federal repeal have been unsuccessful. However, nonprofit organizations and good government groups have raised dire predictions on the potential for corruption absent these federal standards. Political donors directly contributing to their preferred candidate must stay within campaign finance limits and their donation must be publicly reported. Campaign donations confer no tax benefit for the donors. However, should a church or nonprofit be allowed to endorse and support that same candidate, a donor could make a donation exceeding campaign finance limits to that church or organization and then claim a charitable contribution deduction on their taxes. Houses of worship in particular do not need to register with the IRS or file informational returns about their donors, donations, or expenditures, creating a new stream of “dark money” to influence elections.

The bill would codify the Johnson Amendment into state law for any New York corporation, association, trust, fund, foundation, or limited liability organized and operated for religious, charitable, scientific, public safety, literary, or educational purposes as defined by section 501(c)(3) of the internal revenue code, and would continue that requirement in New York even if the Amendment were to be repealed in the future at the federal level.

“The public expects nonprofit organizations to serve public, not political, interests,” said Doug Sauer, CEO of the New York Council of Nonprofits, which represents over 3,000 nonprofit organizations across the state.  “With the Trump Administration threatening to tear down the wall between nonprofits and electoral politics, it’s important that New York establish its own legal framework.”

Senate Passes Inclusive Equal Rights Amendment

Albany – Today the New York State Senate unanimously passed a bill (S.517/A.272), to update the New York State Constitution’s Equal Rights Amendment to be fully inclusive and self-executing. The bill is carried in the Assembly by Assm. Rebecca Seawright. In order to be adopted into the constitution, the amendment must be passed in two consecutive legislative sessions (ie, 2019/20 and 2021/22), then be approved by voters in a referendum.

“Equal rights are for everyone,” said Senator Krueger. “The 1930s-era equal rights language in our State Constitution is long overdue for an update. Women have waited far too long to be included, but so have LGBTQ people, people with disabilities, Latinx people, and everyone who has faced discrimination based on characteristics that are beyond their control. First passage of a real, inclusive ERA in the Senate means we’re one step closer to having a constitution that reflects and protects all New Yorkers.”

“The expansion of equal rights in the New York State Constitution is long overdue,” said Assembly Member Seawright. “We will continue to work with colleagues in the Assembly and the Senate to move towards an expanded constitutional amendment so that the voters of New York can decide at the ballot box.”

The current State Constitution’s equal rights amendment, adopted in 1938, prohibits discrimination based on “race, color, creed, or religion.” The new proposed language would add to that list ethnicity, national origin, age, disability, or sex including pregnancy, sexual orientation, gender identity or expression.

The broadly inclusive language of the amendment surpasses the equal rights provisions of every other state in the nation, as well as that of the U.S. Constitution.Though the federal Equal Rights Amendment, which would have granted women equal rights in the U.S. Constitution, narrowly missed getting enough states to ratify it, 11 states, including California, Oregon and Illinois, have passed state ERAs pertaining to women. New York is not one of those 11 states. No state has explicitly granted equal rights to LGBTQ people or the disabled.

In addition, due to a 1949 court decision, the current constitutional language fails to be self-executing, meaning any protections for individual civil rights must be backed up by specific legislation. Today’s amendment would fix this loophole by clearly defining “civil rights,” thereby making the provision self-executing.

Senate Majority Passes Strongest Tenant Protections In State History

Albany – The Senate Democratic Majority today passed the Housing Stability and Tenant Protection Act of 2019, the strongest affordable housing and tenant protections legislation in state history. This legislation, a 2-way agreement with the State Assembly Majority, was drafted following multiple legislative hearings throughout the state and discussions with advocates, tenants, and stakeholders. This legislation will make these new pro-tenant regulations permanent, repeal vacancy deregulation, reform rent increases for major capital improvements, create transformational protections for all tenants throughout the state, and empower qualified communities outside of New York City to opt into rent stabilization.

The Housing Stability and Tenant Protection Act of 2019, Senate bill S.6458, will make the rent regulation system and tenant protection initiatives permanent, rather than having them sunset as was the policy in the past. This legislation also repeals high-rent vacancy deregulation as well as “vacancy bonus” and “longevity bonus” provisions. This omnibus bill also reforms potential rent increases for major capital improvements and for individual apartment improvements to better protect tenants. Additionally, this historic affordable housing legislation extends certain tenant protections statewide, implements protections for mobile and manufactured home tenants, and empowers qualified localities throughout the state to implement the rent stabilization system.

Across the country we are seeing a resurgence of diseases like measles because of the failure to have children vaccinated – and New York’s outbreak is the largest.

“This has been driven in part by people abusing the vast loophole in our laws created by the religious exemption. The fact that many of those using the current religious exemption are doing so in bad faith is made clear by the arguments employed in opposition to today’s bill, which have relied almost entirely on long-debunked junk science to attempt to prove the dangers of vaccines rather than on any religious scripture. In fact, it is nearly impossible to find any organized religion that has taken a clear official stance against vaccination. Regardless, when one person’s beliefs put other people at risk, the state has an obligation to act.

“The science is clear: vaccines are safe. This is not a religious issue, it is a health issue, and the needs of public health are paramount, particularly those of children and other vulnerable people who cannot be vaccinated for medical reasons. I commend my colleagues in the Senate and the Assembly for passing this bill today, and I look forward to the Governor signing it soon.”
