14 State Senators Call On MTA And Capital Plan Review Board To Comply With Open Meetings Law

Albany – Today 14 State Senators, led by Senator Liz Krueger, released a letter to MTA Chairman and CEO Patrick Foye, Governor Andrew Cuomo, Mayor Bill de Blasio, Assembly Speaker Carl Heastie, and Senate Temporary President Andrea Stewart-Cousins, asserting that the Capital Plan Review Board (CPRB) must abide by the state Open Meetings Law (OML) during the upcoming 2020-2024 MTA Capital Plan process, as they failed to do during the previous 2015-2019 Capital Plan process.  The Senators further implored the MTA’s Traffic Mobility Review Board (TMRB) to comply with the OML during the congestion pricing implementation process. The call from Senators followed a similar letter released earlier in the month by a group of good government and transit advocates. The Senators’ letter can be viewed here, and is also reprinted below.

“The MTA is not only a massive recipient of taxpayer dollars, it is also a vital lifeline that millions of New Yorkers rely on every day,” said Senator Krueger. “That is why it is so important that when critical decisions are made by the MTA, they be made in public. New Yorkers must be able to not only monitor the process of these MTA boards, but also provide input to shape the final product. I hope the MTA will follow the letter and the spirit of the law going forward.”

On August 8th, advocates including Reinvent Albany, Common Cause, NYPIRG, League of Women Voters, Transportation Alternatives, Riders Alliance, and several others, wrote to state elected leaders pointing out that the MTA’s Capital Program Review Board (CPRB) had failed to hold any public meetings during its consideration of the 2015-2019 Capital Plan, in violation of Open Meetings Law. The advocates cited an advisory opinion issued by the state Committee on Open Government finding that the CPRB is a public body, and therefore required to comply with OML.

In response to the advocates’ letter, 14 State Senators have written to MTA Chairman Foye, as well as the four appointing officials of the CPRB (Governor, NYC Mayor, Assembly Speaker and Senate Temporary President),  asserting that the CPRB must comply with the OML during its review of the 2020-2024 Capital Plan. In addition, the lawmakers pressed the Authority to recognize that the Traffic Mobility Review Board (TMRB), the body tasked with implementing the recently-passed congestion pricing law, is also required to comply with OML. The Senators’ letter states that “given the impact of Central Business District Tolling, its vast number of stakeholders, and its directive to consider such subjective factors as “public impact, public safety, and hardships,” we believe it is of the utmost importance that the TMRB conduct a robust process of public engagement.”

Senator Alessandra Biaggi said: “We do a disservice to our communities when we choose to violate the rules and procedures that are designed to strengthen the people’s voice in our democracy. New Yorkers deserve full transparency in the decision making process of policies that affect them and how state funding is distributed. I stand in solidarity with my colleagues in calling on our state and city leadership to ensure the Capital Program Review Board (CPRB) operates in accordance with the Open Meetings Law (OML) as it considers the forthcoming 2020-2024 Metropolitan Transportation Authority (MTA) Capital Program.”

Senator Andrew Gounardes said: “Meetings on the future of mass transit in New York City should be transparent and open to the public.  We the people have a right to see how decisions get made on the issues that will affect our daily lives and commutes. I join my colleague Senator Krueger in demanding that the Capital Program Review Board and the Traffic Mobility Review Board comply with open meetings law.”

“The MTA is the circulatory system of New York City and with so much critical work ahead, it is more important than ever that New Yorkers know that all of its operations are getting a regular checkup,” said Senator Brad Hoylman. “We deserve an MTA that is transparent, open to the public, and responsive to New Yorkers’ concerns. I am grateful to Senator Krueger for her leadership on behalf of New York taxpayers.”

          We write to urge the MTA to fully abide by the requirements of NYS Open Meetings Law (OML).  For the 2015-2019 capital program, the Capital Program Review Board CPRB did not meet publicly, in direct violation of the OML. We therefore want to make sure that the CPRB does comply when it reviews the 2020-2024 Capital Plan.  We further urge the MTA to ensure that the Traffic Mobility Review Board (TMRB) also complies with the OML when it begins meeting.

On August 8, 2019, seventeen organizations, including advocacy, good-government, and industry/trade groups, wrote to you requesting that the CPRB abide by the requirements laid forth in the NYS Open Meetings Law OML. CPRB, clearly meets the OML’s definition of “public body.”  As the organizations’ letter cites, the New York State Committee on Open Government has issued an advisory opinion confirming that the CPRB is indeed a “public body” as defined by the OML, and thus subject to its transparency requirements.

          We further submit that the TMRB, as a subcommittee of the Triborough Bridges and Tunnels Authority (TBTA) of the MTA, falls under the OML’s definition of “public body,” and should be subject to its requirements.  The TMRB has been charged with recommending toll amounts for the forthcoming Central Business District Tolling program, as well as other potential program elements including exemptions, discounts, and credits for certain classes of drivers, vehicles, and routes.  Given the impact of Central Business District Tolling, its vast number of stakeholders, and its directive to consider such subjective factors as “public impact, public safety, and hardships,” we believe it is of utmost importance that the TMRB conduct a robust process of public engagement.  As the OML requires, the TMRB should conduct its business in public, with sufficient notice, and with opportunities for members of the public to submit oral and written testimony.

Bipartisan Group Of 67 Legislators Rebukes Ernst & Young Over Arbitration Policy

Albany – Today a bipartisan group of 67 New York State Legislators, led by Senators Liz Krueger and Alessandra Biaggi, and Assemblymembers Aravella Simotas and Jo Anne Simon, released a letter to Ernst & Young Chairman and CEO Carmine Di Sibio, rebuking the firm for its policy of forced arbitration for harassment and discrimination claims. The letter was motivated by the experience of Karen Ward, a former EY partner, who has been forced into arbitration over her claim to the US Equal Employment Opportunity Commission (EEOC) that she was fired for speaking out against ongoing sexual and gender-based harassment and discrimination at the firm. The letter can be viewed here, and is reprinted below.

“For all the progress women have made to achieve equality in the workplace, some companies still have not gotten the memo that the days of the boys’ club are over,” said Senator Krueger. “It is 2019, not 1959, and it is simply unacceptable to perpetuate a culture of harassment and discrimination at work. Ernst & Young claims to be a leader on gender equity, yet their forced arbitration requirements effectively slam shut the doors on their employees’ access to justice. They can and must do better.”

In September, 2018, Ms. Ward filed a charge with the EEOC alleging sexual harassment and gender discrimination at Ernst & Young. After filing the charge, she publicly requested that then-EY CEO Mark Weinberger release her from a contractual requirement to use arbitration to resolve the claim. Since the time the contract was signed, New York State has passed legislation to ban the future use of such forced arbitration agreements in cases of harassment and discrimination.

“Sexual harassment and discrimination in the workplace often derive from an abuse of power, and a forced arbitration agreement is a continuation of that abuse,” said Senator Biaggi. “It is unacceptable to put a $100,000 price tag on justice for an employee seeking accountability for the harm they have endured. This year we passed S6577/A8421 which will eliminate arbitration agreements for cases of sexual harassment and discrimination to stop employers like Ernst & Young from silencing victims for speaking up. I commend Ms. Ward for coming forward, and demand that Ernst & Young eliminate this predatory policy immediately and start practicing the values they preach.”

In addition to continuing to require arbitration, EY has refused to pay the costs of the arbitration, and the arbitrators have ordered the parties to split the cost, leaving Ms. Ward with a $185,000 bill merely to begin the process of hearing her claim, above and beyond any costs she may incur retaining her own lawyers. With the case still in the discovery phase, she will likely have to pay well over $200,000 to complete the process. By comparison, had she been permitted to file in court, she would only have had to pay a $450 fee.

Ms. Ward has filed a declaratory judgment action in federal court seeking to invalidate the arbitration agreement, claiming that no victim of sexual harassment or discrimination should be required to pay hundreds of thousands of dollars to have their claims heard.

“The case of Karen Ward is a prime example of the evils of forced arbitration agreements and the imbalanced power dynamic within this dispute resolution system,” said Assemblymember Simotas. “Ernst & Young’s policy is an oppressive relic used to put up barriers and prevent targets of harassment from coming forward. This case highlights just how much workers, across all industries, need protections against mandatory arbitration clauses for discrimination claims. These clauses should not be allowed to silence workers and keep discrimination and sexual harassment tucked away in the closet.  I applaud Ms. Ward for pursuing justice and I urge Ernst & Young to do the right thing and allow her to have her sexual harassment and gender discrimination claims heard in court.”

“Forced arbitration in employment cases is problematic and in cases of harassment and discrimination is unacceptable, because it serves as a barrier to accessing the protections of the law, by heaping unnecessary costs on victims of discrimination and harassment, and generally limiting workers’ ability to get a fair hearing,” said Assemblymember Simon. “I’m pleased to stand with my colleagues in the Assembly and State Senate to urge Ernst & Young to reconsider its reliance on forced arbitration in cases of gender based discrimination and harassment in the case of Karen Ward and all of its employees.”

In the letter, legislators take EY to task for requiring Ms. Ward to participate in exorbitantly expensive arbitration, saying “you are effectively silencing her and sending a message to your other employees that their claims will not be given a fair hearing.” Additionally, they charge that EY is failing to live up to the goals of its own “Women. Fast Forward” program, saying “it is time for Ernst & Young to move beyond lip service and make the systemic changes necessary to truly be a leader in addressing inequality in the workplace.”

Dear Chairman Di Sibio,

We write to express our disappointment with the efforts by Ernst & Young to deny your former partner, Karen Ward, a reasonable opportunity to have her claims of sexual harassment and gender discrimination heard in a court of law.  By limiting her recourse to forced arbitration at a personal cost of hundreds of thousands of dollars, you are effectively silencing her and sending a message to your other employees that their claims will not be given a fair hearing and that they will have to pay exorbitant costs to simply have their claims heard.  This case is a particularly egregious example of the abuses that led New York State to pass legislation banning such forced arbitration agreements in cases of harassment and discrimination in the first place.

New York State is not alone in rejecting forced arbitration in cases of harassment.  The private sector has also recognized that these requirements are vestiges of a past where sexual misconduct in the workplace was tolerated or ignored.  Companies such as Microsoft, Uber, Google, Facebook, Lyft, Slack, Airbnb, Skadden, Arps, Slate, Meagher & Flom LLP, Sidley Austin, Kirkland & Ellis, and Orrick, Herrington & Sutcliffe LLP have voluntarily dropped mandatory arbitration requirements.  It is disturbing that Ernst & Young is unwilling to recognize the negative impact arbitration requirements have on the ability of workers to get a fair hearing and the chilling effect these agreements can have on reporting.

While the problems with forced arbitration are clear, the facts in this case are even more troubling.  Ernst & Young has insisted that Ms. Ward pay half the costs of arbitration, which have already added up to $185,000 with the case still in the discovery phase.  If she had been permitted to file in court, she would have only had to pay $450 in court costs to have her case heard.  It is obvious to us that requiring claimants to pay such exorbitant costs is a major obstacle to justice for victims of harassment.

Ernst & Young ostensibly created the “Women. Fast Forward” program to “highlight [y]our own commitment to the advancement of women in the workplace” and to “offer leadership and guidance as [you] call upon others to put gender on their agenda.”  However, Ernst & Young cannot be a leader on gender equality while it is so far behind the curve in addressing workplace harassment and continues to place barriers in the way of victims who are merely seeking a fair chance at justice.

We urge Ernst & Young to reconsider its outdated approach to addressing gender inequity and show that it is committed to providing all employees with a harassment-free workplace by ensuring they have access to our justice system to address discrimination claims.  Ernst & Young’s current policy of outrageously expensive, binding arbitration imposes impossible burdens on those who seek relief.  It is time for Ernst & Young to move beyond lip service and make the systemic changes necessary to truly be a leader in addressing inequality in the workplace.

Senator Krueger Hosts Forum on Scams

New York – Yesterday State Senator Liz Krueger hosted a Forum on Scams, focused on protecting individuals from predatory phone calls, emails, and letters. The forum was held at Lenox Hill Hospital in Manhattan, and co-sponsored by New York City Council Member Keith Powers and the NYPD 19th Precinct. Speakers included Police Officers Anthony Nuccio and Tyle Scherpich from the 19th Precinct, and Chuck Bell, Programs Director at Consumer Reports.

Statement From Senator Liz Krueger On Passage Of Sexual Harassment Bill

Albany – State Senator Liz Krueger released the following statement today regarding S.6577, legislation that addresses workplace harassment:

“I am humbled and honored that in our first session in the Majority we were able to deliver this critically important piece of legislation on behalf of women and men across New York State. I am hopeful that because of this legislation, as part of a much larger agenda of addressing harassment in the workplace, five years from now we will be able to look back and say ‘it’s getting better.’ We have made clear today that you can’t get away with it anymore.

“For years I have heard from young women right here in the Legislature who have been harassed and abused in their workplace. They told me they couldn’t afford to lose their job, they couldn’t afford to come forward. They were convinced that if they did, they’d never work in Albany again.

“Nobody should have to be afraid when they go to work that they are going to have to face violations not just of their bodies but of their souls. Because that’s what it is to be abused and harassed and sexually attacked in the workplace.

“The legislation we passed today is not yet enough, but it is a huge victory nonetheless. I am so proud of my colleagues, especially Senator Biaggi and the other new senators who have done an extraordinary job getting us here. I also want to recognize the members of the Sexual Harassment Working Group who so boldly came forward, demanded we do better, demanded we listen to their stories, and demanded we and pass legislation that is more than just a feel-good effort.

“New York State now has some of the strongest protections against harassment in the nation, and I will continue to work with my colleagues and advocates to modernize our laws and protect all New York workers.”

Statement From Senator Liz Krueger On The Marijuana Regulation And Taxation Act

Albany – State Senator Liz Krueger released the following statement today regarding S.1527, the Marijuana Regulation and Taxation Act:

“It is clear now that MRTA is not going to pass this session. This is not the end of the road, it is only a delay. Unfortunately, that delay means countless more New Yorkers will have their lives up-ended by unnecessary and racially disparate enforcement measures before we inevitably legalize.

“Through months of negotiation and conversation with the Governor’s office and my legislative colleagues, we made great strides to improve our bill and bring more people on board. We came very close to crossing the finish line, but we ran out of time.

“I will continue to push for a tax-and-regulate adult-use program with all the right safeguards in place, one that centers on restorative justice and reinvestment in the communities most harmed by decades of failed prohibition policies.

“We will build on the success of other states who have chosen to legalize, including many of our neighbors. I have no doubt that prohibition is an outdated and irrational policy, and its days are numbered.”
